Venue Terms of Service

These Venue Terms of Service ("Venue Terms") govern your use of ArcadeGo as a venue owner, operator, or manager ("Venue Operator"). They supplement our general Terms of Service, which also apply to your account.

By creating a venue account or claiming a venue listing, you agree to these Venue Terms. If you are accepting on behalf of a business, you represent that you have authority to bind that business.

1. Eligibility

To register as a venue operator, you must:

  • Be at least 18 years old
  • Be authorized to act on behalf of the venue or business you are registering
  • Provide accurate, complete, and current registration information
  • Comply with all applicable local, state, and federal laws governing your business

2. Venue Accounts

Your venue account grants access to listing management tools, analytics, waiver features, and other operator-specific capabilities.

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity conducted through your account
  • Keeping your contact information current and accurate
  • Ensuring only authorized personnel access your account

You may not share accounts across multiple unaffiliated businesses or individuals.

3. Claiming and Managing Venues

ArcadeGo allows you to claim venue listings and manage associated content.

By claiming a venue, you represent and warrant that:

  • You are authorized to manage the venue's public presence
  • All submitted information is accurate and not misleading
  • Uploaded photos and media are owned by you or used with permission
  • You will keep listing details (hours, contact info, attractions) reasonably current

ArcadeGo reserves the right to verify ownership, investigate disputes, and revoke management access if a claim is found to be unauthorized or fraudulent.

4. Listing Content Standards

Venue listings must accurately represent your business. You agree not to:

  • Post false, misleading, or deceptive information
  • Use the listing to promote a different business or redirect players
  • Upload content that violates intellectual property rights
  • Include offensive, adult, or illegal content
  • Artificially inflate ratings, reviews, or engagement

ArcadeGo may remove or correct listing content that violates these standards without prior notice.

5. Platform Data

Information you submit to your venue listing — including venue details, hours, attractions, events, and media — becomes part of ArcadeGo's platform dataset.

By submitting this information, you grant ArcadeGo a perpetual, irrevocable, worldwide, royalty-free license to use, display, adapt, distribute, and otherwise exploit that content in connection with operating and promoting the Service, including for commercial purposes.

ArcadeGo maintains ownership of the platform dataset as a compiled work. This does not affect your ownership of any underlying intellectual property you contributed.

If your account is closed, your venue listing may remain on the platform in a managed or unclaimed state to preserve continuity for players.

6. Waiver Tools

ArcadeGo may provide tools that allow venue operators to create, distribute, and collect digital liability waivers from customers.

Your Responsibilities

As the waiver operator, you are solely responsible for:

  • Ensuring your waiver templates comply with applicable laws in your jurisdiction
  • Obtaining appropriate legal review of waiver language before use
  • Providing required disclosures to your customers before they sign
  • Securely storing and managing waiver records as required by law

ArcadeGo provides the technical mechanism to collect signatures. We are not a law firm and do not provide legal advice. The enforceability of any waiver is your responsibility.

Customer Data

Personal information collected from your customers through the waiver system (names, contact information, signatures) is processed by ArcadeGo on your behalf. You must have a lawful basis to collect this information and must provide appropriate notice to your customers. You may not use this data for purposes unrelated to your venue operations or in violation of applicable privacy laws.

7. SMS Notifications

By providing a phone number in connection with your venue account, you consent to receive transactional SMS messages from ArcadeGo related to venue operations, including waiver notifications and account alerts.

You may opt out at any time by replying STOP to any SMS from us or updating your notification preferences in account settings. Message and data rates may apply.

8. Subscriptions and Billing

Certain venue features may require a paid subscription. Subscription terms, pricing, and billing details are presented at the time of purchase and are incorporated by reference.

Unless otherwise stated:

  • Subscriptions renew automatically unless cancelled before the renewal date
  • Refunds are not provided for unused portions of active subscription periods
  • ArcadeGo reserves the right to change pricing with reasonable advance notice

Core listing and claim features are currently available at no charge. ArcadeGo may introduce pricing for additional features in the future.

9. Reviews and Reputation

Player reviews of your venue are community-generated content governed by our general Terms of Service. You may respond to reviews through your venue dashboard.

You agree not to:

  • Solicit or incentivize fake positive reviews
  • Attempt to have legitimate negative reviews removed without valid grounds
  • Harass or threaten players who submit reviews

ArcadeGo does not remove reviews solely because a venue operator disagrees with them. We will investigate and act on reviews that violate our content policies.

10. Prohibited Conduct

In addition to the prohibitions in our general Terms, venue operators agree not to:

  • Use the platform to collect customer data for purposes beyond your venue operations
  • Misrepresent your business, ownership, or authorization
  • Use waiver or communication tools to send spam or unsolicited marketing
  • Attempt to access or modify another venue's listing or data
  • Automate or script interactions with the venue dashboard

11. Privacy

Your use of venue features is governed by our Venue Privacy Policy in addition to our general Privacy Policy.

12. Termination

ArcadeGo may suspend or terminate your venue account if you violate these Venue Terms, abuse the platform, submit fraudulent information, or engage in activity that harms players, other operators, or the platform.

You may close your account at any time. Upon closure:

  • Your venue listing may remain on the platform in an unclaimed state
  • Waiver records may be retained as required by law or for dispute resolution
  • Public contributions (listing content, events) remain part of the platform dataset per Section 5

13. Disclaimers

ArcadeGo provides venue management tools on an "as is" basis. We do not guarantee:

  • Uninterrupted access to the venue dashboard or waiver tools
  • The legal enforceability of waiver templates
  • Any specific volume of player traffic to your listing
  • Accuracy of analytics data

14. Limitation of Liability

To the fullest extent permitted by law, ArcadeGo and its operators shall not be liable for indirect or consequential damages arising from your use of venue features, including losses arising from unenforceable waivers, player disputes, listing inaccuracies, or service interruptions.

Our total liability shall not exceed the amount paid by you to ArcadeGo in the preceding 12 months, if any.

15. Indemnification

You agree to indemnify and hold harmless ArcadeGo, its operators, affiliates, and employees from claims, damages, and costs arising from your venue content, your use of waiver tools, your customers' interactions with your venue, your violation of these Venue Terms, or your violation of applicable laws.

16. Governing Law

These Venue Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles. Disputes shall be resolved in courts located in Michigan unless otherwise required by applicable law.

17. Changes to These Terms

We may update these Venue Terms periodically. Continued use of venue features after updates constitutes acceptance of the revised Terms.
